Any contact information submitted to Rustico Tile and Stone will only be used by employees of Rustico Tile and Stone for the sole purpose of consultation/sales of material.   

Terms of Service:

Your invoice is attached.  Please review the invoice, Terms and Conditions, and Disclaimers.  Contact us with any questions prior to making payment.  Payment applied toward this invoice indicates you have read and accept the terms and disclaimers below.

Payment methods accepted include:

  • Check mailed to: 21600 Nameless Road, Leander, TX 78641. Please make checks payable to Rustico Tile and Stone. 
  • Scan/email a clear copy of check.
  • Wire Transfer (Please request the wire transfer bank instructions)
  • Bank Deposit to Wells Fargo account (Please request our bank account information)

Terms and Conditions / Shipping Details:

  • Balance due must be paid in full prior to shipping.  Ship date on invoice is an estimated date.
  • All sales of shipped materials are final.
  • In the case of non-custom orders that have not shipped, a 20% restocking fee shall apply.  Customer shall receive a refund of the price paid, less the restocking fee, on cancelled orders.  Shipping is refunded in full.
  • All Custom Orders, Painted or Copper Products, and Shipped orders are Final Sales.
  • It is the customer’s responsibility to offload materials from the truck for commercial deliveries.  Extra shipping charges incurred because the customer does not have requisite equipment for unloading freight shall be charged to the customer. 
  • Delivery to residences that include a liftgate must be unloaded on flat areas.  Freight company drivers are only obligated to unload the freight from the truck.  Inside delivery can be requested but extra charges will apply.
  • Freight charges are based on fuel rates as of the invoice date.  If freight cost is significantly higher at the time of shipping, we reserve the right to invoice for any difference in shipping rates.
  •  Customer is responsible for previewing the invoice to confirm correct merchandise is ordered.  Merchandise stated on the invoice will be shipped and be considered correct.
  • Installation of product constitutes acceptance.  No claims shall be filed after installation.  Any damage or quality concerns must be addressed prior to installation and within 3 days of delivery.
  • With the shipping of RUSTICO TILE AND STONE products, some chipping and breakage should be expected. Any chipping or breakage that is less than 15% of the overall square footage ordered will be considered acceptable. Upon photographic evidence of damage AND notation of Damage on Delivery receipt at the time of delivery (in excess of 15%), RUSTICO TILE AND STONE will provide compensation in the form of replacement product or partial credit to customer’s account.
  • Sealed saltillo tiles are not guaranteed against scratching.  Application of topcoat sealer removes most scratches that may have during transit and grouting.
  • All prices are in US dollars.
  • Changes to delivery address after order is completed are subject to additional charges. Address changes may not be possible after product is in transit. All address changes must be made through RUSTICO TILE AND STONE and may incur additional charges by the freight company.
  • The laws of the State of Texas shall apply to this transaction.  Venue of any action related to this order shall be in Travis County, Texas.
  • No representations other than those contained in the invoice and these terms and conditions have been made or relied upon by either party to this transaction.  The Disclaimers below are expressly incorporated into these terms and conditions and Purchaser acknowledges being advised of the expected properties of the natural products listed below.

 

Disclaimers

Important: These disclaimers form part of the terms and conditions of this transaction and describe the characteristics of the products you are purchasing.

 Saltillo tile: Due to the natural properties of handmade saltillo tile, even with attempts to narrow the range of variation, there can be moderate to dramatic variations in color, shading and pattern.  Saltillo tile has many color variations ranging from dark orange, red, yellow, and light pink.  Manganese Saltillo will vary from light gray, brown, and darker brown.  Manganese will also have random black swirling from the manganese dioxide AND it will have shades of terra cotta colors that bleed through the clay.  It is impossible for us to send only red, orange, or yellow tiles or to send single shades of color with manganese saltillo.  There will also be moderate to dramatic variations in sealer finish, existence of lime pops, bumps, chips, cracks, and occasional paw prints.  No two saltillo tiles are the same.  These variations are expected characteristics of saltillo tile and are not considered a defect.  They are marks of authentic saltillo tile.  To select saltillo tile is to accept its natural properties.  Rustico Tile and Stone will not be responsible for any variation in coloration, shading or pattern.

Sealer: It is important that sealer applied to any RUSTICO TILE AND STONE material must be compatible with the substrate.  Customer is responsible for the selection and application of sealer and any dye colors.  Sealer not purchased from RUSTICO TILE AND STONE is not warranted by RUSTICO TILE AND STONE.  Directions for application of sealer purchased from RUSTICO TILE AND STONE will be provided by the manufacturer. These directions must be followed precisely.  Sealer has a 1-year shelf life.  Any sealers must be applied on a thoroughly dry and clean floor.  It is recommended to test a small area of substrate prior to applying a coat across the entire surface.  All sealer sales are final.  Returns are subject to a 20% restocking fee and must be authorized by RUSTICO TILE AND STONE.

 Talavera Tile:  Variations in shading and texture and size are inherent.  This enhancement often simulates the beauty.  Such variation is not considered a defect.  Shading variation may also occur with different production runs.  For these reasons, the tile products in your home may not match display samples.

Travertine Stone: Travertine is a natural product.  Due to its properties, there can be moderate to severe variations in color, shading and pattern.  This is a natural characteristic and not considered a defect.  In addition, hairline cracks and veining are common and create weak spots within the tile/slab.  RUSTICO TILE AND STONE will not be responsible for any variation in coloration, shading, pattern and/or cracks and veining. 

To select travertine is to accept its natural properties.  Travertine is full of gas bubbles (“holes”) which give travertine its characteristic appearance.  When it is manufactured into a tile or slab, these holes in the travertine generally filled with cement and then polished or honed.  When holes are filled by the quarry there is no guarantee the holes will be filled with a cement color that blends. Due to the filling of holes with a different material, the finish of the surface will have irregularities. Holes are not considered a defect.  RUSTICO TILE AND STONE will not replace tiles deemed unacceptable due to “holes” or filling nad will not be responsible for repairs or replacement associated with holes or filling. 

Travertine is highly porous which makes it highly susceptible to the absorption of water, oils, grease and dirt.  Spills from food, carbonated beverages, juices, wine, oils, grease, etc can cause stains and/or etching.  It is HIGHLY recommended that natural stone products are sealed with a sealer appropriate for the stone.  Sealing will minimize any absorption of liquids that might stain the material.  Care should be taken in the selection of sealers, as some sealers may enhance (darken) the color of the stone.  Although honed travertine is a stone, it is still a soft surface that can be scratched.  Moving furniture, pebbles stuck in the bottom of a shoe, etc. can cause scratches in the surface of the travertine.  RUSTICO TILE AND STONE will not be responsible for repairs or replacement associated with scratches. 

 Due to the difficulties of cutting natural stone, there may be variation in the edge treatments and size within a batch.  Some edges may have beveled edge while others do not.  Similarly, some may be exactly the size specified while others may be 1/8” smaller or larger.  RUSTICO TILE AND STONE will not be responsible for such irregularities.

 Cantera Stone: Cantera is a natural product.  Due to its properties, there can be moderate to severe variations in color, shading and pattern.  This is a natural characteristic and not considered a defect.  In addition, hairline cracks and speckling are common and create weak spots within the tile/slab.  RUSTICO TILE AND STONE will not be responsible for any variation in coloration, shading, pattern and/or cracks and speckling. 

To select cantera is to accept its natural properties.  Cantera is known for color variations and speckles of colors throughout the stone.  These are not considered defects.  RUSTICO TILE AND STONE will not replace tiles deemed unacceptable due to color variations and speckling.

 Copper:   It is important that copper products be cared for properly.  Do not use abrasive or acidic agents to clean copper.  RUSTICO TILE AND STONE recommends a protective wax coating be applied to your copper product prior to use.  Your copper purchase is hand-hammered with variations in patina shade, size, and shape.  Returns for copper products are subject to a 20% restocking fee and must be authorized by RUSTICO TILE AND STONE.

 

Returns Policy:
Any returns must be pre-authorized by Rustico Tile and Stone.  In some cases, a restock fee may apply.
